Commissioner of Competition files application regarding the proposed acquisition of Plains Midstream Canada ULC by Keyera Corp.

Ottawa, Ontario, May 19, 2026 - Notice is hereby given that on May 4, 2026, an application pursuant to section 92 of the Competition Act, RSC 1985, c C-34, was filed with the undersigned at the Competition Tribunal (the “Tribunal”) by the Commissioner of Competition (the “Commissioner”), regarding the proposed acquisition of Plains Midstream Canada ULC from Plains Midstream Luxembourg S.A.R.L. by Keyera Corp. (the “Proposed Merger”).
The particulars of the orders sought are as follows:
- an order directing Plains Midstream Canada ULC, Plains Midstream Luxembourg S.A.R.L. and Keyera Corp. not to proceed with the Proposed Merger;
- in the alternative, an order directing Keyera Corp. not to proceed with the acquisition of Plains Midstream Canada ULC’s fractionation and storage business at Plains Fort Saskatchewan, and all associated infrastructure required to preserve the level of competition that would prevail but for the Proposed Merger;
- an order requiring Plains Midstream Canada ULC, Plains Midstream Luxembourg S.A.R.L., Plains All American Pipeline, L.P. and Keyera Corp. to pay the costs of this proceeding; and
- such further and other relief as the Commissioner may request and this Tribunal may consider appropriate.
Notice is hereby given that any motion for leave to intervene in this matter must be filed with the Registry on or before June 29, 2026.
