Dear [insert addressee's name]

Thank you for your letter of [insert date of addressee's letter] concerning [insert CF member's rank and name].

I can confirm that [insert CF member's rank and name] has been given a copy of your letter.

I regret to advise you that the Canadian Forces normally has no power to compel one of its members to settle a private debt. However, in accordance with section 15 of the Garnishment, Attachment, and Pension Diversion Act, and regulations made under the National Defence Act, the Canadian Forces is authorized to order compulsory payments in respect of certain financial support orders and judgment debts. For further information, you may refer to Section 2 of Chapter 207 of the Queen's Regulations and Orders for the Canadian Forces, available on the Internet.

Please note that section 267 of the National Defence Act provides that "No judgment or order given or made against an officer or non-commissioned member by any court in Canada shall be enforced by the levying of execution on any arms, ammunition, equipment, instruments or clothing used by that officer or non-commissioned member for military purposes."

I trust the foregoing clarifies the position of the Canadian Forces concerning the settlement of a CF member's private debts.

Yours truly,
