Bannister court martial decision to be appealed

Colonel Bruce MacGregor, Director of Military Prosecutions, has today announced that the prosecution has filed a notice of appeal with the Court Martial Appeal Court of Canada in the case of Captain T.J. Bannister, the defendant in a standing court martial that concluded in Charlottetown on February 27, 2018.

The standing court martial found Captain Bannister not guilty on three counts of disgraceful conduct contrary to section 93 of the National Defence Act, and three counts of conduct to the prejudice of good order and discipline contrary to section 129 of the National Defence Act. The prosecution asserts that the military judge’s decision erred in law.

Written arguments will be filed with the Court Martial Appeal Court, a civilian body comprised of a panel of three judges drawn from the Federal Court of Appeal, the Federal Court and provincial superior courts. The date for an appeal hearing has not yet been set by the court.

  • The charges against Captain Bannister stemmed from incidents that allegedly occurred between November 2012 and June 2015 in Montréal and Charlottetown while he was serving as the Commanding Officer of 148 Royal Canadian Army Cadet Corps.
