Improvement plan

The Labour Program is committed to ensuring its regulatory guidance is clear, comprehensive and written in plain language. Interpretations, policies, and guidance (IPGs) are developed and updated in consultation with stakeholders through various mechanisms, such as meetings with the Occupational Health and Safety Advisory Committee.

The Labour Program consulted with stakeholders in 2014-15 as part of its normal, ongoing consultation practices, during which stakeholders were provided the opportunity to identify gaps in interpretations and existing guidance that need clarification. Stakeholders underlined the importance of developing and publishing an IPG on violence prevention in the workplace. This IPG has now been released.

The Labour Program's improvement plan outlines priorities for improving guidance to stakeholders on regulatory requirements during 2015-2017. Stakeholder consultations will be ongoing during this period and frequently asked questions will be updated as further consultations occur.

Amendments to the Canada Labour Code on prorated holiday pay came into force March 16, 2015, which make this IPG no longer necessary. The IPG will remain in effect until March 31, 2016, to allow processing of outstanding complaints.

What are the roles and responsibilities of employers and the Labour Program in investigations of harassment or bullying complaints?

Program response: The Labour Program’s role is to ensure that employers comply with the relevant regulations requiring policies and procedures to be in place to prevent violence. Guidance is being developed and will be published in an IPG to clarify procedures and requirements with regard to violence prevention in the workplace.

I am a truck driver. Am I eligible for overtime pay? If so, when does overtime pay become payable?

Program response: An IPG is being developed to clarify overtime pay requirements.
