5. Next steps

Within 48 hours of receiving the form, the Federal Workers’ Compensation Service will:

  • confirm your status for your employee’s eligibility under the Government Employees Compensation Act; and
  • verify the claim to ensure the information is accurate and complete.

If a third party is not involved in the claim, the Federal Workers’ Compensation Service will then forward the form to the appropriate provincial workers’ compensation agency for adjudication. The provincial workers’ compensation agency determines whether the injury or illness is work-related and the amount of benefits to be provided.

Finding out if an employee’s claim is accepted or denied

The Federal Workers’ Compensation Service will notify you of the decision of the provincial workers’ compensation agency. Employees can request a re-evaluation of their case if the decision is unfavourable. The employee, the employer, or a representative of the employee or the employer may ask for a review by contacting the appropriate provincial authority, as outlined in the letter of decision.

Review and appeals

If you or the employee disagree with the decision, you can request an appeal with the appropriate workers’ compensation agency.

Getting the employee back to work

Federal government employees are eligible for rehabilitation services and medical treatment through the provincial workers’ compensation agencies.

If the employee has a temporary disability:

As soon as the employee is well enough, you must make every effort to assign them suitable work until they are able to resume their pre-accident duties.

If the employee’s injury or illness permanently restricts them from resuming their former duties:

As soon as the employee is well enough, you must help them to obtain work appropriate for their abilities.

Some provinces offer career rehabilitation and training for a different type of work to employees whose injury or illness leaves them with a permanent disability, making it impossible to resume their former occupation.
