Memorandum of Understanding for the exchange of confidential and personal information for the administration and enforcement of the Cannabis Act and the Excise Act, 2001 between the CRA and Health Canada.
With which third party is Health Canada sharing personal information
Under this Memorandum of Understanding (MOU), the Controlled Substances and Cannabis Branch at Health Canada (HC) and the Canada Revenue Agency (CRA) share personal and confidential information with each other. This two-way disclosure came into effect on October 4, 2024. HC and the CRA will review this agreement within ten years.
Why is Health Canada sharing personal information
Anyone who grows or processes cannabis for business (commercial) purposes must have both a valid license from HC, and a valid license from the CRA. To manage this, HC and the CRA regularly share information with each other to ensure that applicants and licenses holders follow the rules of the Cannabis Act and the Excise Act, 2001.
What personal information is Health Canada sharing
HC may share the following personal information with the CRA:
- Applicant, license holder, responsible person or other registered person's name(s) contact information and/or application number
- HC License information (number, class/sub-class, expiry date, status)
- Site address
- Inspection information
- Compliance information
- Information and data reported by license holders through the Cannabis Tracking System
- A declaration pursuant to subsection 10(2) of the Cannabis Regulations, if applicable
