Memorandum of Understanding – Second Language Evaluation for Oral Proficiency: Overview of the conditions surrounding the administration of the Second Language Evaluation Oral Test regulated by the Public Service Commission

Under this Memorandum of Understanding (MOU), the Official Language Centre of Expertise at Health Canada (HC) shares personal information to the Public Service Commission of Canada (PSC). This one-way, indeterminate disclosure came into effect on July 28, 2023. HC and PSC will review this MOU every five years beginning on July 28, 2026, to ensure its accuracy and compliance.

Why is Health Canada sharing personal information

HC and PSC created this MOU so that HC can perform its own Second Language Evaluations (SLE) for employees and candidates for employment in HC and in the Public Health Agency of Canada. HC must use PSC testing material and share exam records and results with PSC. HC uploads audio recordings and/or written records of the SLE oral tests to the PSC through the On-line Oral Proficiency System (OOPS). The Public Service Employment Act, the Employment Equity Act and the Canadian Human Rights Act (section 16) allow this information sharing.
