Regulations Amending the Cannabis Regulations (New Classes of Cannabis)
On December 20, 2018, Health Canada launched a public consultation on draft Regulations Amending the Cannabis Regulations (New Classes of Cannabis). This consultation builds on the extensive consultations conducted by the Task Force on Cannabis Legalization and Regulation.
Consistent with the comprehensive public health approach to the regulation of all cannabis products established by the Cannabis Regulations, the draft regulations propose to establish new regulatory controls to address the public health and public safety risks associated with edible cannabis, cannabis extracts, and cannabis topicals. These new classes of cannabis will be permitted for legal sale under the Cannabis Act no later than October 17, 2019.
Health Canada also intends to update the Cannabis Tracking System Order to reflect these new classes of cannabis. The Cannabis Tracking System Order compels the provision of information (including cannabis production, inventories, distribution and sales) from reporting parties, supporting the broader goal of tracking the high-level movement of cannabis throughout the supply chain to prevent inversion or diversion of cannabis into or out of the legal system.

The proposed amendments to the Cannabis Regulations are expected to generate a net cost to federal licence holders, and to have considerable benefits for public health and public safety. For more information, please see the Regulatory Impact Analysis Statement.
Proposed amendments to the Cannabis Regulations were published in the Canada Gazette, Part I, on December 22, 2018. The draft regulations were subject to a 60-day public consultation period which ended February 20, 2019. All feedback received is being carefully reviewed, and will inform development of the final regulations.
Health Canada intends to publish final regulations in the Canada Gazette, Part II, by no later than October 17, 2019.
