Description

Health Canada is proposing regulatory amendments to exempt certain classes of pest control devices and products from the registration requirements under the Pest Control Products Act (e.g., to eliminate regulatory duplication, codify current policies and ensure appropriate oversight of regulated products), and to clarify the scope of the requirements with respect to devices to help ensure there are no regulatory gaps.

This regulatory initiative was identified by Health Canada in the Agri-food and Aquaculture Sector Regulatory Review Roadmap.

This regulatory initiative is associated with Health Canada's Regulatory Stock Review Plan.

Regulatory cooperation efforts (domestic and international)

This initiative is not part of a formal regulatory cooperation work plan.

Potential impacts on people in Canada, including businesses

It is anticipated that the proposed regulatory amendments would increase predictability for businesses to determine whether their products or devices must be registered, and reflect current marketplace needs.

A reduction in administrative burden is also expected as a number of products of low- or well-characterized risk would be exempt from the registration requirements under the Act.

Consultations

Pre-consultations in advance of Canada Gazette, Part I were undertaken starting on November 30, 2018, and lasting 90 days.

People in Canada will have the opportunity to provide comments on the proposed regulatory amendments during the Canada Gazette, Part I, public comment period, which is expected to take place in spring 2024 and last 75 days.

Health Canada plans to publish the amended regulations in the Canada Gazette, Part II in fall 2024.
