Compliance of a Material Safety Data Sheet and Label
Health Canada determines whether the (material) safety data sheet ((M)SDS) and any label(s) submitted with the claim for exemption comply with the Hazardous Products Act and the Hazardous Products Regulations. Compliance with the Controlled Products Regulations is permitted during the transition period.
In cases where the total formulation of the controlled or hazardous product is not supplied, the claimant is asked to provide the chemical identity and concentration of any ingredient present at 0.1% or greater. A literature search of public sources is initiated to gather available hazard information that may be relevant.
A review and evaluation is undertaken of toxicological studies, supporting information and the materials retrieved during the literature search.
If there are any (M)SDS/label-related representations received from affected parties, these must also be considered, pursuant to the earlier publication of the notice of filing in the Canada Gazette.
Once the review of the information from all sources is completed, a final decision is made on (M)SDS compliance in accordance with the authority provided by the Hazardous Materials Information Review Act.
