Humanitarian and compassionate consideration in Canada: Positive Stage 1 assessment – applicant has left Canada

Applicants who receive a positive Stage 1 assessment after removal from Canada by the Minister (R239), or who voluntarily depart, and who are not otherwise inadmissible, may be allowed to return to Canada. However, there is no requirement to re-admit applicants who have received a positive Stage 1 H&C assessment and who seek to return to Canada to finalize the application.

When a positive Stage 1 assessment is made after an applicant has left Canada, send a Stage 1 approval letter and a IMM 5669 Schedule A (PDF, 247 KB) (PDF, 776.39KB) to the applicant and/or counsel.

If the applicant does not respond after 60 days, make a final decision with the information on the file.

If the applicant provides the information as requested, send the application for Stage 2 processing.
