Program delivery update: New pilot program to exempt permanent residence applicants in the family class or the spouse or common-law partner in Canada (SPLPC) class from paragraph R117(9)(d) or R125(1)(d) exclusion

A new, 2 year pilot program has been put in place via the temporary public policy to facilitate the immigration of certain sponsored foreign nationals under the family class or the spouse or common-law partner in Canada (SPLPC) class who would normally be excluded, per paragraph 117(9)(d) or 125(1)(d) of the Immigration and Refugee Protection Regulations (IRPR).

Under paragraph R117(9)(d) or R125(1)(d), a foreign national who did not have a non-accompanying family member examined at the time the foreign national applied for permanent residence cannot later apply to sponsor that family member.

This pilot is in effect from September 9, 2019, to September 9, 2021.

The family class instructions have been updated to include new instructions on this pilot program. The section “Declaration and examination of family members” of Assessment of an application for permanent residence has also been updated.
