The Government of Canada is moving to modernize Canada’s intellectual property (IP) regime and join five international IP treaties: the Protocol Relating to the Madrid Agreement Concerning the International Registration of Marks (the Madrid Protocol), the Singapore Treaty on the Law of Trademarks (the Singapore Treaty) and the Nice Agreement Concerning the International Classification of Goods and Services for the Purposes of the Registration of Marks (the Nice Agreement) for trademarks, the Hague Agreement Concerning the International Registration of Industrial Designs (the Hague Agreement) for industrial designs, and the Patent Law Treaty for patents.

The Government of Canada is conducting public consultations on proposed amendments to the Trade-marks Regulations through the Canada Gazette, Part I. The period for public comment is 30 days, between February 10, 2018 and March 11, 2018.

A new Patent Prosecution Highway (PPH) pilot arrangement, implemented by the Canadian Intellectual Property Office (CIPO) and the Taiwan Intellectual Property Office (TIPO), will commence on February 1, 2018, for a period of three years, ending on January 31, 2021.

The Patent Prosecution Highway (PPH) pilot agreement between the Canadian Intellectual Property Office (CIPO) and the European Patent Office (EPO) has proven very successful. By the end of September 2017, the EPO had received a total of 102 requests under the trial: 64 based on Patent Cooperation Treaty (PCT) work products and 38 based on national work products. By the same date, CIPO had received a total of 406 requests: 325 based on PCT work products and 81 based on regional work products.

The Visegrad Patent Institute (VPI) will be joining the Global Patent Prosecution Highway (GPPH) pilot program as of January 6, 2018. The VPI is an intergovernmental organization for cooperation in the field of patents. It was established by the four Visegrad countries: the Czech Republic, Hungary, the Republic of Poland and the Slovak Republic. The VPI is an International Searching Authority and International Preliminary Examining Authority under the Patent Cooperation Treaty (PCT). There are now 25 patent offices, including Canada’s, that are participating in the GPPH.
