RCMP Grievance Process and the Role of the ERC - Key Steps
RCMP
Grievance submitted in writing by RCMP member.
Level 1 Review conducted by RCMP officer designated as Level 1 Adjudicator.
Adjudicator makes a decision.
If Grievor does not wish to pursue matter further, end of grievance process.
Otherwise, Grievor requests that grievance be referred to Level II review.
If not referable, Level II review through internal RCMP process.
If referable, the RCMP Commissioner refers grievance to ERC for its review at Level II.
ERC
ERC receives request from RCMP Commissioner.
ERC Chair, with support of staff, reviews the case.
ERC Chair arrives at findings and makes recommendations.
ERC Chair issues findings and recommendations to RCMP Commissioner and the parties (end of ERC involvement).
RCMP/Other
RCMP Commissioner reviews case, and reaches a final decision, then notifies the parties and the ERC.
If Grievor does not wish to have decision reviewed, end of grievance process.
If Grievor wishes to have decision reviewed, Grievor applies to Federal Court to review RCMP Commissioner's decision.
Federal Court process.
Note:
Grievances that are referred to ERC are:
- Interpretation and application of government-wide policies that apply to members of the RCMP;
- stoppage of pay and allowances during suspension of a member;
- interpretation and application of the Isolated Posts Directive;
- interpretation and application of the Relocation Directive;
- administrative discharge on grounds of physical or mental disability, abandonment of post, or irregular appointment.
Note: Grievances that are not in these categories are reviewed through the internal RCMP process.
