ED 200-4 - Guidelines for Excise Duty Licensing and Bonding - Change After Issuance of Licence

Pursuant to the Excise Act, an application for licence is required for a change in name, ownership or transfer from one premise to another.

COMPLIANCE

1. (1) An application for a new licence will be submitted whenever there is

(a) a change in ownership of a business licensed under the Excise Act, or

(b) a change in the location of a licensed premises.

(2) Unless otherwise provided for, such applications for licence are subject to the same terms and conditions as an original application for licence.

2. (1) As a change of corporate name in no way affects the right or obligations of a company, a new licence is not required for the remainder of the fiscal year.

(2) Upon changing name, the licensee will immediately provide the Department with:

(a) an application in the new name;

(b) a letter advising of the change of name along with a certified true copy of the supplementary letters patent amending the corporate name;

(c) a new guarantee bond or rider bearing the new name of the licensed establishment; and

(d) new plans and specifications if required by the Regional Director of Excise.

3. Where a licence is transferred from one premise to another within the same Excise division, the licensee will submit:

(a) an application for licence;

(b) a new bond; and

(c) new plans and specifications.

4. While an amending licence (M1) will be issued, no additional licence fee is required for the balance of the fiscal year when:

(a) a change of location takes place within the same excise region; or

(b) a change of name occurs.

Regional Directors are requested to insure that a copy of this Circular is forwarded by registered mail to all Excise Duty Licensees concerned who are located in their regions.
