Forward Regulatory Plan: 2019 to 2021: amending the Public Service Superannuation Regulations (pensionable service status of periods of absence without pay)
Title or working title of regulatory initiative
Amending the Public Service Superannuation Regulations (pensionable service status of periods of absence without pay)
Amendments to the Public Service Superannuation Regulations (PSSR) (pensionable service status of periods of absence without pay) are required as current provisions dealing with contributions owing by a pension plan contributor for periods of leave without pay are not completely aligned with the enabling legislation. Recent amendments to the Canada Labour Code and Employment Insurance legislation extend the circumstances where it is mandatory to provide employees with leave of absence without pay and with the same benefits as other employees during that period. Of note, these changes extend the period for maternity and parental benefits, and create new periods of compassionate care leave to look after a family member who is gravely ill.
To amend the existing provisions to ensure the recognition of the new periods of mandatory leave.
This regulatory initiative is associated with the department’s Regulatory Stock Review Plan: 2019 to 2029.
