Forward Regulatory Plan: 2021 to 2023: Amending the Public Service Superannuation Regulations (pensionable service status of periods of leave without pay)
Title or working title of regulatory initiative
Amending the Public Service Superannuation Regulations: pensionable service status of periods of leave without pay
Amendments to the Public Service Superannuation Regulations (PSSR) are required because current provisions dealing with contributions owing by a pension plan contributor for periods of leave without pay do not align with recent amendments to the Canada Labour Code, which extends the circumstances where it is mandatory to provide employees on leave without pay with the same benefits as other employees during that period. Of note, these changes concern leave for caregiving purposes (e.g., maternity and parental leave, and compassionate care leave to look after a family member who is gravely ill).
To amend the existing provisions of the PSSR to extend its present leave without pay exemptions to other types and durations of leave without pay taken for caregiving purposes.
This regulatory initiative is associated with the department’s Regulatory Stock Review Plan: 2020 to 2030.
