Rationale

Review of regulations to align with legislative review

Narrative

Amendments to the Access to Information Regulations are needed following the coming-into-force of Bill C-58 on June 21, 2019. Bill C-58 amended the Access to Information Act to remove the legislative authority to enact regulations for any fees other than the application fee. Amendments to the Access to Information Regulations are therefore necessary to remove all references to search and preparation fees. As well, amendments to the Access to Information Regulations following Bill C-58 are also required to provide clear authority for institutions to require adequate identification from requesters to confirm that they have a right, under the Access to Information Act, to access the information or records they are requesting, including personal information. This regulatory initiative is included in the department’s Forward Regulatory Plan: 2020 to 2022.

Also, as a result of the coming-into-force of Bill C-58, a legislative review of the Access to Information Act must be undertaken by June 21, 2020 and every five years thereafter. The Access to Information Regulations will be revisited after each legislative review of the Access to Information Act to ensure that they align with any changes made as a result of these legislative reviews.
