Agreement to amend the Canada–Alberta Early Learning and Child Care Agreement 2021 to 2025 – Annex 3:  Early childhood workforce funding for fiscal year 2021 to 2022

Referred to collectively as the “Parties.”

Preamble

Whereas the Parties concluded the Canada – Alberta Early Learning and Child Care (ELCC) Agreement (“Agreement”) on July 23, 2021.

Whereas at the time of the signing of the Agreement, the Parties agreed that in fiscal year 2021 to 2022, at the request of Alberta and subject to approval of Canada’s Treasury Board, Alberta may retain and carry forward to the following fiscal year any unexpended early childhood workforce funds remaining from Alberta’s annual contribution up to a maximum of 10%.

Whereas Alberta indicates that since signing the Agreement, Alberta has experienced challenges preventing them from fully expending their workforce funding allocation.

Whereas the Parties agree to increase in fiscal year 2021 to 2022, Alberta’s carry forward allowance from 10% to 17.9% for fiscal year 2021 to 2022 into fiscal year 2022 to 2023 for its workforce funding.

Now therefore, the parties agree to amend the Agreement, as follows.

  1. Section 4.0 is amended by adding section 4.6.6 as follows
    • “4.6.6 In fiscal year 2021 to 2022, at the request of Alberta, and subject to the approval of Canada’s Treasury Board, Alberta will retain and carry forward to the following fiscal year any unexpended funds remaining from Alberta’s annual contribution paid under section 3.3 of Annex 3, up to a maximum of 17.9% of the contribution paid. Any unexpended funds in excess of 17.9% of this contribution paid represents an overpayment subject to section 4.7 of this Agreement”
  2. Section 13.0 is amended by replacing section 13.1 with the following
    • “13.1 This Agreement, including Annexes 1, 2, 3, and 4 comprise the entire agreement entered into by the Parties with respect to the subject matter hereof”
  3. Section 3.0 of Annex 3 Early Childhood Workforce Funding for fiscal year 2021 to 2022 is amended by replacing section 3.4 with the following
    • “3.4 Sections 4.6.1 to 4.6.6 of the Agreement, respecting carry forward, apply to funds provided under this annex”
  4. The Agreement remains unchanged in all other aspects
  5. This amending agreement shall be read in conjunction with the Agreement and shall take effect as if its provisions were an integral part of the Agreement
  6. This amending agreement shall take effect upon its signatures by both of the Parties
