The grievor contested the dates of his promotion to the ranks of Lieutenant (Lt) and Captain (Capt). The grievor had transferred to a new occupation after failing in his first occupation. Following a successful grievance submission, he was subsequently returned to his original occupation to complete his training. After successfully qualifying in his occupation, he felt aggrieved when his promotion date to Lt did not reflect his original enter promotion zone (EPZ) date.

Since no Initial Authority decision was rendered within the permissible four month timeframe, the grievor requested that his file be transferred to the Final Authority for adjudication.

The Committee found that the delay in completion of the grievor's occupational training was for military reasons and, as such, the original EPZ date should stand. The Committee recommended that the grievor's date of promotion to Lt be restored to his original EPZ date, that his date of promotion to Capt be amended, and that his pay, incentive categories, rank seniority and EPZ to Major all be adjusted accordingly.
