Initial Counselling (IC), Remedial Measures

The grievor disagreed with the remedial measure he received for demonstrating a personal bias while performing his duties.  

The Initial Authority found that the Initial Counselling (IC) correctly identified specific shortcomings in the grievor's performance.  

The Committee noted that the grievor had limited training and experience for his duties and that he did not demonstrate a performance deficiency over a reasonable period of time as required by the Defence Administrative Orders and Directives 5019-4, Remedial Measures.  Accordingly, the Committee found that the IC for performance should be quashed.

Regarding the grievor's conduct, the Committee found that it may have been appropriate to issue an IC for conduct, specifically for failing to maintain the Canadian Armed Forces' trust while performing his duties.  However, the issue was specifically addressed in the grievor's Personnel Development Review and seemed to have been corrected. Accordingly, the Committee found that it would be pointless at this stage to issue a corrective measure.  

The Committee recommended that the IC be removed from the grievor's file.
