The grievor, a senior non-commissioned member, received a counselling and probation (C&P) for making inappropriate sexualized comments. The grievor argued that the C&P was not justified and that the process for administering it was unfair.

The Initial Authority reviewed the circumstances and concluded that the grievor should have known that his comments were inappropriate based on his previous Initial Counselling regarding a similar matter, his rank and his training.

The Committee determined that the grievor failed to meet the standard of conduct directed under Operation HONOUR and concluded that the imposition of a remedial measure was appropriate.

In light of the grievor's experience, rank and training, the Committee found that the grievor's conduct deficiency was serious enough to warrant a remedial measure of C&P. The Committee recommended that the grievance be denied.
