The grievor, a Master Corporal in the Reserve Force (Res F), transferred to the Regular Force (Reg F) at the rank of second lieutenant (2Lt). He disagreed with his rank and pay awarded upon transfer.

The Director General Military Careers, acting as the Initial Authority (IA), partially granted the redress. The IA explained that the grievor was transferred under the Direct Entry Officer (DEO) plan because there is currently no policy applying to Res F non-commissioned members, with a suitable degree, who transfer to the Reg F in officer occupations. Reviewing the Canadian Armed Forces recruiting incentives and allowances standard for the pilot occupation, the IA determined that the grievor's four-year Bachelor of Fine Arts degree satisfied the requirement for Pay increment 1.

The Committee found that, in accordance with Canadian Forces Administrative Order 11-6, as a DEO candidate with the Basic Military Officer Qualification, the grievor was eligible for promotion to 2Lt on transfer. Pursuant to the Compensation Benefit Instruction 204.015, as an officer commissioned to an officer rank directly from the rank of Corporal or above, the grievor was entitled to pay level D.

The Committee recommended that the Chief of Defense Staff's authority be granted to award the grievor with the pay rate of 2Lt, pay level D as of the date of his transfer and that his pay be adjusted accordingly.

FA decision summary

The Final Authority (FA), the Chief of the Defence Staff, agreed with the Committee's recommendations that the grievor be paid, on component transfer, as a second lieutenant, pay level D, and that an additional pay increment be granted to recognize the grievor's graduate studies.

The FA agreed with the Committee's finding that it was appropriate to determine the grievor's pay in accordance with the provisions for Direct Entry Officers under the Compensation and Benefits Instructions and Canadian Forces Administrative Order 11-6. The FA acknowledged that there was a gap in policy with respect to reservists with post-secondary degrees transferring to the Regular Force and indicated that the Chief of Military Personnel was working on policies to address the issue.
