The grievor challenged the refusal to pay him for work performed on the 31st day of a month for Class ā€œCā€ Reserve Force (Res F) service. The grievor was not paid because the Revised Pay System for Reservists only considered 30 days per month for Class ā€œCā€ service. The Initial Authority rejected the grievance because it was not submitted within the required timeframe.

In previous files on this same issue, the Canadian Armed Forces (CAF) relied upon an interpretation by a Treasury Board (TB) analyst that Reservists cannot be paid for the 31st day of any month. The Committee has consistently found this an erroneous interpretation of the Compensation and Benefits Instructions for the Canadian Forces. 

The Committee recommended the grievor be paid for the 31st day of the month in question. The Committee also recommended that the Final Authority (FA) order that any Res F members who have been denied compensation for service on the 31st day of any month have their pay audited. The Committee further recommended that the FA issue a CAF-wide message to inform Res F members of this issue and to prevent further mismanagement of Res F pay.

FA decision summary

The FA, Director Canadian Forces Grievance Authority, agreed with the Committee's finding that the grievor had been aggrieved. However, the FA disagreed as to the appropriate remedy. The FA affirmed she did not have the authority to pay the grievor for the 31st day of the month and granted one day of special leave instead. The FA also noted that this issue is being addressed. The Chief of the Defence Staff recently directed the Commander Military Personnel Command to work with the TB to amend the policy so that it allows members in the grievor's position to be paid for work performed on the 31st of the month. Finally, the FA asked the Acting Chief of Military Personnel to consider issuing a Canadian Forces General Message to update Res F members of the ongoing issue.
