Course failure, Cease-Training, Entry into the Promotion Zone

The grievor argued that the enter promotion zone (EPZ) date from Second Lieutenant (2Lt) to Lieutenant (Lt) was incorrectly recalculated following a course failure. The grievor submitted that the course failure should have been registered as incomplete because of bias experienced during the Progress Review Board (PRB). As redress, the grievor requested that the EPZ date to Lt be reverted to the original date and that the course report be adjusted to reflect the result of the PRB

The Initial Authority rejected the grievance based on the time limit established under article 7.06 of the Queen's Regulations and Orders in the Canadian Forces.

The Committee found that the grievor and the chain of command had reached an informal resolution regarding the outcome of the PRB through a separate Notice of Intent to Grieve. It was agreed that the grievor's first attempt at the course remained a course failure and the grievor would be recoursed on the next serial to complete the outstanding training. The Committee concluded that it would be inappropriate to revisit the reasonableness of the outcome of the PRB.

Regarding the EPZ date, the Committee referred to paragraph 18 of Annex A to Canadian Forces Administrative Orders 11-6, Commissioning and Promotion Policy – Officers – Regular Force, which indicates that officers who fail to complete their training for reasons other than “military reasons” will have their EPZ date to Lt recalculated based on the date the training commenced. The Committee found that there was no indication that the course failure was caused by “military reasons” and, as such, the grievor's EPZ date to Lt was calculated correctly and in accordance with policy.
