Grievable issue under the National Defence Act, Harassment

The grievor challenged his chain of command's denial of his request for information regarding any disciplinary or administrative action brought against a complainant, another Canadian Armed Forces member, following an unfounded harassment complaint. As redress, the grievor requested to be informed of any action taking against the complainant. 

The Initial Authority rejected the grievance based on the grievor submitting it outside of the time limits established in article 7.06 of the Queen's Regulations and Orders for the Canadian Forces.

The Committee concluded that the grievor did not have the right to access another individual's personal information, as per the Privacy Act and the Access to Information Act, nor any administrative actions brought against the complainant, if any, as it would be considered personal information. The Committee further found that the denial to provide the requested information to the grievor was justified.

The Committee recommended that the Final Authority not afford the grievor redress.
