The grievor disputed the decision by the Government of Canada Pension Centre Eligibility Review Team denying the grievor's request to buy back previous service after having missed the deadline to elect to do so. The grievor claimed that he had previously made a buy back requestand that it had not been actioned properly.

The Director General Compensation and Benefits, acting as the Initial Authority (IA), rejected the grievance, noting that a separate mechanism was provided under the Canadian Forces Superannuation Act to address the grievor's pension concerns. As such, the IA refused to consider the grievance application under the Canadian Armed Forces grievance system.

The Committee found that the grievor had provided no evidence that they had submitted the requisite buy back form within the required timeframe. As such, the Committee was unable to find, on a balance of probabilities, that the grievor's request was ever submitted. The Committee found that the one-year deadline had long since passed and that the grievor was no longer eligible to elect a buy back and top up of service for their pension.

The Committee recommended that the Final Authority not afford redress.
