Terms and conditions of employment for the employees who occupy excluded positions in the Law Practitioner Group

I am pleased to announce the alignment of the terms and conditions of employment for the employees who occupy excluded positions in the Law Practitioner (LP) Group to the work related terms and conditions of employment contained in the Law Practitioner Group collective agreement. These changes are effective as of with the exception of Appendix B and C of the collective agreement which are effective from .

Performance Pay for employees occupying excluded positions in the Law Practitioner Group

Appendix B and C of the LP collective agreement (the performance pay plans) are effective from for the performance review period of 2012-2013.  This means that, as noted in the Information Bulletin, if performance pay was already paid out to an employee who occupies an excluded position in the LP group for the 2012-2013 performance review period based on the the Performance Pay Administration Policy for Certain Non-Management Category Senior Excluded Levels adjustments will need to be made so that they are in-line with what is provided in the collective agreement.

Rates of Pay

The rates of pay applicable to employees who occupy excluded positions in the LP group were previously approved and applied with instructions to disregard pay note 12 found in the collective agreement. With the approval of the alignment to the terms and conditions of employment of the collective agreement, the pay notes will need to be applied as per the collective agreement, including pay note 12. In other words employees who occupy excluded positions in the LP group will receive the conversion to lock step pay scale prior to any performance pay for the period of 2012-2013.
