By-law no. 3

A by-law respecting Inspectors of the Canadian Grain Commission

Being a by-law to repeal and replace by-law No. 3 dated July 5, 2018.

BE IT ENACTED as a by-law of the Canadian Grain Commission as follows:

  1. Inspectors - Pursuant to paragraph 12(d) of the Canada Grain Act (the Act), the Commission hereby designates the persons occupying the following positions as Inspectors:

    Executive Division
    1. Commissioners
    2. Chief Operating Officer
    3. Chief Financial Officer
    Industry Services Division
    1. Director of Industry Services Division
    2. Chief Grain Inspector for Canada
    3. Chief of Grain Weighing Services for Canada
    4. National Manager of Weighing Services Process Compliance
    5. Manager, Weighing Services, Western region
    6. Manager, Weighing Services Eastern region
    7. National Quantity Assurance Specialist
    8. Quantity Assurance Specialists
    9. Entomologist
    10. All grain inspectors employed by the Commission
    11. Manager, Safeguards for Grain Farmers
    12. Head, Licensing
    13. Head, Audits
    14. Compliance Auditors
    15. Compliance Officers
  2. Certificates – Pursuant to section 88(2) of the Act, the persons designated as inspectors by this by-law shall be furnished with a certificate of designation, in English and French, that includes the following statements:
    • The holder of this certificate has been designated by the Canadian Grain Commission as an inspector under the Canada Grain Act, with the powers established under that Act.
    • The inspector may, among other powers, enter any elevator, any premises of a licensee of an elevator, and any premises of a licensed grain dealer, and may examine the premises, grain and equipment, take samples of grain, and make copies of or take extracts from documents in the premises.
  3. Counterpart – This by-law may be executed and delivered via facsimile or PDF and in any number of counterparts, each of which shall be deemed to be an original and all or which taken together shall be deemed to constitute one and the same instrument, and it shall not be necessary in making proof of this by-law to produce or account for more than one such counterpart.
