Update on restorative engagement to address sexual misconduct

Since October 2020, the Sexual Misconduct Response Centre held virtual consultations with various stakeholders to develop and implement the Restorative Engagement program. These consultations included persons affected by sexual misconduct and subject matter experts in sexual trauma and restorative justice. As a result of these consultations and consistent with the intent of the CAF-DND Sexual Misconduct Class Action Final Settlement Agreement, the Restorative Engagement program design evolved to better meet the needs of those affected by sexual misconduct and effect culture change.

As part of those consultations, those directly affected by sexual misconduct specifically requested that all leaders, not only senior leaders, be involved in restorative engagement. They also voiced that they want the opportunity to share their knowledge and understanding of sexual misconduct and its causes and impacts, not necessarily their personal experience. The Sexual Misconduct Response Centre is developing the Restorative Engagement program in collaboration with Integrated Conflict and Complaint Management and is implementing these recommendations in the program design.

By participating in the program, current and former eligible Defence Team members can share their experiences, knowledge and understanding of sexual misconduct to be heard and acknowledged by the Canadian Armed Forces and Department of National Defence. They can also share their insights about what needs to change and contribute to broader culture change efforts. Specially-trained and experienced restorative practitioners will facilitate participation in the program and any engagement between participants. Participation in restorative engagement is voluntary and confidential within legal limitations. Participants can withdraw at any time.

Current and former Defence Team members who experienced sexual harassment, sexual assault, gender or LGBTQ2+ discrimination in a military workplace can request to participate in restorative engagement by submitting a claim no later than 24 November, 2021. A claim can be modified to express interest in restorative engagement before or after that date as long as the claim is submitted before 24 November, 2021.
