Canadian Armed Forces Delayed Pension Class Action
April 23, 2025 - Defence Stories
Canadian Armed Forces (CAF) members: Did you experience a delay in receiving a pension benefit under the Reserve Force Pension Plan or the Regular Force Pension Plan? If you served in the CAF with at least some of that service in the Reserve Force, and were released between 2007 and 2017, you may be entitled to a payment under a settlement.
The proposed settlement compensates CAF members who experienced delays in the processing and payment of their pension benefits.
You may be eligible to make a claim for compensation if:
- You served in the Reserve Force;
- You were released from the CAF between March 1, 2007 and October 31, 2017;
- You were entitled to receive an Immediate Annuity, Transfer Value, Annual Allowance and/or Bridge Benefit under the Regular Force Pension Plan or the Reserve Force Pension Plan; and
- You did not receive payment of the Immediate Annuity, Transfer Value, Annual Allowance and/or Bridge Benefit for more than 60 days from the date of your release.
(Note: A delay of 60-90 days is considered reasonable and will not be compensated.)
The Proposed Settlement
If approved, the proposed settlement provides compensation for delays in the payment of certain pension benefits under the Reserve Force Pension Plan or the Regular Force Pension Plan during the Class Period from March 1, 2007, to October 31, 2017. The payments under the proposed settlement are intended to compensate Class Members for the experience of delay, rather than any economic loss.
The amount of compensation to be paid to any individual Class Member depends on the type of pension benefit paid to the Class Member and the length of the delay in payment. Class Members who received a Monthly Benefit (Immediate Annuity, Annual Allowance and/or Bridge Benefit) may be eligible to receive payment in accordance with the following payment schedule:
91 to 150 Days’ Delay |
151 to 365 Days’ Delay |
366 to 730 Days’ Delay |
Over 730 Days’ Delay |
---|---|---|---|
$400.00 | $600.00 | $800.00 | $1,200.00 |
Class Members who received a Transfer Value may be eligible to receive payment in accordance with the following payment schedule:
Over 181 Days’ Delay |
---|
$600.00 |
