Comments on the proposed risk management approach for ethyloxirane to be addressed as part of the Chemicals Management Plan Challenge were provided by Dow Chemical Canada and the Canadian Environmental Law Association.

Comment Response
Neither the proposed risk management approach nor the risk management scope documents propose specific actions, regulations or instruments which could prompt early stakeholder feedback. At the time of publication it was felt that further consultation with stakeholders was required before any specific actions could be recommended.
Substances already subject to provincial regulation may be adequately managed without additional federal action. The Government of Canada considers existing risk management controls, including actions by provinces, in its recommendations. The federal government will determine, in consultation with stakeholders, including provincial governments, whether additional action is warranted.
For the risk management of ethyloxirane, the government indicated that it considers it necessary to be informed of any proposed new activities. However, the notification mechanism was not specified. The application of the Significant New Activity provisions under the Canadian Environmental Protection Act, 1999 (CEPA 1999) to this substance will be recommended. This would require that any proposed new manufacture, import or use be subject to further assessment, and would determine if the new activity requires further risk management consideration.
The potential for increased use of ethyloxirane as an alternate dry cleaning solvent, currently used by only one facility in Canada, poses a concern. The approach document notes that use of this solvent in dry cleaning operations is not expected to result in releases. However, the government intends to evaluate any potential expanded use of ethyloxirane in this application.
