Information Summary
This document summarizes the information collected by the Government of Canada under the Notice with respect to certain inanimate substances (chemicals) on the Domestic Substances List published in the Canada Gazette on October 3, 2009.
The Government of Canada used the mandatory information gathering provisions of section 71 of the Canadian Environmental Protection Act, 1999 (CEPA 1999) to gather basic information on approximately 500 inanimate substances (chemicals) from the 2008 calendar year. This information complemented the information collected or generated as part of the DSL Categorization process in order to inform prioritization of these substances and subsequent risk assessment and management activities.

The Domestic Substances List was first compiled in the early 1990’s to identify substances that were in commerce in Canada between 1984 and 1986. At the time of compilation, basic information such as substance quantities, uses and industry sectors involved were collected. The DSL is the sole basis for determining whether a substance is new for the purposes of CEPA 1999 and may therefore be subject to the New Substances Notification Regulations (Chemicals and Polymers) (SOR/2005-247) or whether an animate substance is new and may therefore be subject to the New Substances Notification Regulations (Organisms) (SOR/2005-248).
As commercial activities with some substances can vary greatly over time, the DSL information is dated and may no longer represent current commercial activity in Canada. The purpose of the first phase of the DSL Inventory Update (IU) was to gather information to determine the current commercial status of approximately 500 inanimate substances, to help set priorities, and to provide an updated knowledge base in support of subsequent risk assessment and risk management activities.
The Government of Canada collected information on the manufacture and import of approximately 500 substances, whether alone, in a mixture, in a product or a manufactured item during the 2008 calendar year.
Persons that met the reporting requirements were required to submit the following information:
- Substances manufactured and/or imported in 2008 (CAS RN[1] and substance name);
- Quantities of the substances manufactured and/or imported (expressed as a range);
- NAICS Code(s): six-digit North American Industry Classification System (NAICS) code(s) which identify the sectors involved in the manufacture or import of the substances;
- Industrial Function Code(s): which identify the intended physical or chemical characteristic for which a chemical substance or mixture is consumed as a reactant; incorporated into a formulation, mixture, reaction product, or article; repackaged; or used (e.g., reaction intermediate);
- Consumer and Commercial Code(s): which identify the use of a chemical substance that is directly, or as part of a mixture, a product, or a manufactured item, sold to or made available to consumers for their use; as well as the use of a chemical substance, or the use of a mixture, product or manufactured item containing a chemical substance, in a commercial enterprise providing saleable goods or services;
- Percentage of the total quantity manufactured and/or imported for each industrial function code and consumer and commercial code reported (expressed as a range); and
- Intended Use of the Substance: whether it is intended for use in commercial activities, consumer activities, or use by or for children.
Reporting Thresholds and Exemptions
The DSL IU section 71 Notice applied to any persons who, during the 2008 calendar year, manufactured or imported a total quantity greater than 100 kilograms of a substance listed in the notice, whether alone, in a mixture, in a product or in a manufactured item.
The Notice did not apply to a substance that was (a) in transit through Canada; or (b) a hazardous waste or hazardous recyclable material within the meaning of the Export and Import of Hazardous Waste and Hazardous Recyclable Material Regulations and that is imported in 2008 pursuant to a permit issued under those Regulations.
Responses to the section 71 Notice included both the mandatory submissions received from persons/organizations that met the reporting requirements as well as the voluntary submissions from interested stakeholders.
Voluntary submitters included:
- Persons/organizations that are below the reporting threshold for the 2008 calendar year. These companies may manufacture or import below 100 kg or may have met the reporting threshold of 100 kg for a different calendar year;
- Persons/organizations that use the substance;
- Distributors of the substance whether alone, in a mixture or a manufactured item;
- Persons/organizations that have a vested interest in the fate of the substances;
- Persons/organizations that completed the Declaration of Stakeholder Interest form; and
- Foreign persons/organizations.
Declaration of Non-Engagement forms were voluntarily submitted to the Government of Canada by persons/organizations that did not meet the reporting requirements of the notice, and had no commercial interest in the substances included in the notice.
Table 1 identifies the type and number of submissions received by the Government of Canada in response to the DSL IU.

The section 71 Notice requested information on approximately 500 substances for the 2008 calendar year, as listed in Table 2:
- Approximately 290 substances were reported under the DSL IU (either through a mandatory or voluntary section 71 submission, or a declaration of stakeholder interest form).
- Approximately 210 substances were not reported as manufactured or imported in Canada during the 2008 calendar year (no mandatory or voluntary responses were received). The list of approximately 210 substances for which no information was submitted in response to the section 71 Notice can be found in Appendix A: DSL IU No Data Submitted Substances (2008 information).
- Approximately 260 substances were reported as manufactured and/or imported into Canada during the 2008 calendar year at a quantity greater than 100 kg. The list of approximately 260 substances for which information was submitted in response to the section 71 Notice can be found in Appendix B: DSL IU Data Submitted Substances (2008 information).
- Approximately 30 substances were not reported as manufactured or imported in Canada during the 2008 calendar year at a quantity greater than 100 kg; however, there were interested stakeholders identified for these substances. The list of approximately 30 substances for which stakeholder interest information was submitted can be found in Appendix C: DSL IU Stakeholder Interest Only Substances (2008 information).
- Approximately 115 substances identified in the notice were reported as manufactured in Canada during the 2008 calendar year at a quantity greater than 100 kg.
- Approximately 250 substances identified in the notice were reported as imported in Canada during the 2008 calendar year at a quantity greater than 100 kg, either alone, in a mixture or in a manufactured item.

For each substance reported, the notice required persons/organizations to indicate whether the substance had commercial or consumer uses, and if it was present in products intended for use by or for children up to 14 years of age. As listed in Table 3:
- Approximately 75% of the substances reported under the DSL IU were incorporated into products with commercial uses.
- Approximately 55% of the substances reported under the DSL IU were incorporated into products with consumer uses.
- Approximately 20% of the substances reported under the DSL IU were used in products intended for use by or for children (up to 14 years of age).

The information collected under the DSL IU supports key initiatives of the next phase of the Chemicals Management Plan (CMP). The information will inform risk assessment and management activities with respect to specific substance groupings. The data collection process will also inform the second phase of the DSL IU. Lessons learned on reporting requirements, information requested and deadlines will be used to refine future information gathering initiatives.
