Decision of no danger rendered on work refusal by customs officers

OTTAWA, ONTARIO-Today, Labour Program health and safety officers rendered a decision of no danger following an investigation of a work refusal by customs officers at the Fort Erie Peace Bridge, the Niagara Falls Rainbow Bridge and the Queenston-Lewiston Bridge in Queenston, Ontario.
The Labour Program of Human Resources and Skills Development Canada develops, administers and enforces legislation and regulations related to the workplace, including the Canada Labour Code. Part II of the Code provides that an employee may refuse to work where he or she has reasonable cause to believe that performing an activity constitutes a danger. Unless the workplace health and safety committee can immediately resolve a refusal to work, Labour Program health and safety officers must investigate and render a determination on the situation.
When a decision of no danger is rendered, the employee must return to work. The employee can, however, appeal the health and safety officers' decision of no danger to an appeals officer. The employee must make the appeal within 10 days of receiving the decision. While the appeal is in progress, the employee must return to work. An employee who chooses not to go back to work is no longer protected by the Code.
