FISHING VESSELS ASSOCIATED WITH CRAB PROTEST IN ST. JOHN'S FINED

News Release

No. A001/06
For release February 27, 2006
ST. JOHN'S, NL - A Newfoundland and Labrador provincial court judge has
ordered MV Lady Theresa H, MV Atlantic Gale, and the MV Meagan and Michael III
to each pay a $3,000 fine relating to an incident in St. John's harbour and its
approaches on April 27th, 2005.
On April 27th, 2005, these three vessels were involved in a protest in St.
John's harbour and its approaches, relating to the crab fishery in Newfoundland
and Labrador. By manoeuvring in a manner that interfered with safe navigation,
these vessels disrupted the normal operations of the Port of St. John's.
As a result of a Transport Canada and a Canadian Coast Guard investigation,
charges were laid against the three vessels under Rule 15(a) of the Collision
Regulations of the Canada Shipping Act and section 562.18 of the Canada Shipping
Act which deals with Vessel Traffic Services.
All three vessels pleaded guilty to the charges of failing to keep out of the
way of another vessel that was entering the harbour, and of refusing to comply
with a direction from the St. John's Marine Traffic Regulator. The vessels were
subsequently fined $3,000 each by the court.
Transport Canada and the Canadian Coast Guard are committed to the safe movement
of vessels in Canadian waters. Penalties imposed by the courts act as a
deterrent for any would-be offender.
