On January 26, 2007, California Fruit Market Ltd., Winnipeg, Man., entered a guilty
plea in Manitoba provincial court for violating one count of the Food and Drugs Act
and was fined $20,000.
Between February 27, 2003 and February 20, 2004 California Fruit Market Ltd. knowingly
sold wiener/sausage products to the general public that had been classified as not for
human consumption. This was contrary to Section 5(1) of the Food and Drugs Act.
Section 5 of the Food and Drugs Act requires that no person shall label,
package, treat, process, sell or advertise any food in a manner that is false, misleading,
deceptive or is likely to create an erroneous impression regarding its character, value,
quantity, composition, merit or safety.
The CFIA is responsible for enforcing a variety of federal legislation, including the Food
and Drugs Act. It protects consumers by contributing to food safety, the protection
of plants and the health of animals in Canada.
