$45,000 FINE FOR MARINE POLLUTER

HALIFAX – A Nova Scotia provincial court judge has fined the Bahamian
registered bulk carrier/tanker the Motor Vessel (M/V) Nobel Fortuna $45,000
for violations under the
Canada Shipping Act associated with the
unlawful discharge of an oily substance into Canadian waters.
On December 16, 2005 an oil slick was detected in the Cabot Strait,
approximately 20 nautical miles east of Glace Bay, Nova Scotia. A subsequent
investigation by Transport Canada determined that the slick, containing
approximately 5.5 litres of oil, originated from the M/V Nobel Fortuna. On
May 18, 2007, in Nova Scotia Provincial Court the vessel was found guilty of
unlawfully discharging a pollutant and failing to report the discharge of a
pollutant.
The court imposed a penalty of $40,000 for the pollution violation and
$5,000 for failing to report a pollution incident.
Transport Canada is committed to ensuring environmentally responsible
commercial marine operations and to prosecute marine polluters whenever
there is sufficient evidence. Penalties imposed by the courts act as a
general deterrent for any would-be polluter.
The Department continues to work in close cooperation with other federal
agencies, such as Fisheries and Oceans,
Environment Canada, the
Department
of National Defence and
Justice Canada, as well as with other national and
international partners in order to reduce the occurrence of ship source
marine pollution in Canadian waters.
