Consultation details
An independent review of the Preclearance Act, 2016 (PCA), its administration and operation is underway, as required by law. As part of this review, information will be collected from stakeholders that will help evaluate the effectiveness and appropriateness of the provisions of the Preclearance Act, 2016, and its corresponding Regulations, and to identify any measures that could improve preclearance legislation. The report will be used to identify gaps, support future programming activities, and inform policy.

This independent review of the administration and operation of the Preclearance Act, 2016, is being conducted by InterVISTAS on behalf of the Government of Canada.

As part of this independent review input is being sought from the public and stakeholders such as:
- General Public / Travellers
- Transportation Facility Operators
- Transportation Carriers
- Industry Associations
- Think Tanks and Civil Liberty Groups
- Other Government Departments and Agencies
Key questions for discussion
Ideas and input are being sought on the following topics:
- Legislative framework of the Preclearance Act
- Authorities of U.S. Preclearance Officers
- Authorities of Canadian Border Services Officers
- Facility and Traveller Obligations
- Potential Improvements to preclearance legislation
Input gathered through this process will be reflected in a final report to be tabled in each House of Parliament, on any of the first 15 days on which each House is sitting after the report is completed.
