Transport Canada orders Nissan Canada to inform vehicle owners of a safety defect

New ministerial power invoked for first-ever use

February 12, 2016 – Ottawa, Ontario – Transport Canada

On behalf of the Honourable Marc Garneau, Minister of Transport, Transport Canada has ordered Nissan Canada to immediately inform certain vehicles owners of a safety issue.

The safety issue applies to owners of 2005 and 2006 Nissan X-Trail models. A defect in the fuel reservoir filler pipe coating could result in dangerous fuel leaks if unrepaired.

While these vehicles were recalled by Nissan in 2014, the department remains very concerned the defect hasn’t been corrected in enough of the affected vehicles.

The Minister of Transport obtained the authority to order a manufacturer to further inform vehicle owners of a safety issue in 2015. This power, known as a Subsequent Notice Order, has never before been invoked.

The order requires Nissan to identify and contact the current owners of 2005 and 2006 X-Trail models by using vehicle registration information. Costs associated with this process will be paid by Nissan.

Nissan is now also required to send Transport Canada quarterly reports on the progress of this recall.

Transport Canada believes that notifying current owners will result in more recall work being completed on the affected.

  • Legislative changes that came into effect in 2015 were made to provide the Minister with the power to order companies to issue a Subsequent Notice Order in cases where an inadequate number of vehicles have been repaired. Previously, Transport Canada could only recommend such an action.
  • The defect in question is with the fuel reservoir filler pipe coating, which could allow corrosion to form, potentially resulting in a dangerous fuel leak.
  • A total of 22,245 vehicles were affected under this recall.
  • Certain 2005 and 2006 Nissan X-Trail vehicles were recalled in 2014 under recall #2014030. Owners of affected vehicles that have not been repaired should receive a letter in the coming weeks.
