Why was the policy changed?

CD 084 has been updated and its scope broadened to include instructions on inmates' access to the police, the right to counsel under the Canadian Charter of Rights and Freedoms and a requirement for considering legal counsel in minor disciplinary charges under certain circumstances.

Why was the policy changed?

The changes clarify inmate rights and bring the CD into compliance with Federal Court decisions and the Canadian Charter of Rights and Freedoms.

How was it developed?

The Office of the Correctional Investigator was consulted on current issues as well as institutitons, inmates, Legal Services and the NHQ Policy Branch, NHQMC and Assistant Deputy Commissioners.

Accountabilities?

Compliance will be monitored through the Performance Assurance Sector in accordance with the framework.

This policy impacts on offenders and on staff.
