Part 12: Consequential Amendments, Repeal and Coming into Force

344. Schedule II to the Access to Information Act is amended by striking out the reference to

Loi canadienne sur la protection de l'environnement

and the corresponding reference to "sections 20 and 21".

345. Subsection 656(2) of the Canada Shipping Act is replaced by the following:

Discharges permitted under Canadian Environmental Protection Act, 1999

(2) Notwithstanding any regulation made under subsection (1), a discharge of a pollutant from a ship is permitted if done in accordance with a permit granted under Division 3 of Part 7 of the Canadian Environmental Protection Act, 1999.

346. Item 72 of the schedule to Part XX.1 of the Criminal Code, as enacted by section 4 of An Act to amend the Criminal Code (mental disorder) and to amend the National Defence Act and the Young Offenders Act in consequence thereof, being chapter 43 of the Statutes of Canada, 1991, is replaced by the following:

72. Section 274 -- damage to environment and death or harm to persons

347. Subsection 30(1) of the Food and Drugs Act is amended by adding the following after paragraph (l):

(l.1) respecting the assessment of the effect on the environment or on human life and health of the release into the environment of any food, drug, cosmetic or device, and the measures to take before importing or selling any such food, drug, cosmetic or device;

348. Section 13 of the Manganese-based Fuel Additives Act and the heading before it are replaced by the following:

13. Paragraphs 218(1)(a) and (j), subsections 218(2) to (6) and (10) to (14) and sections 219, 220, 223, 224, 226 to 230 and 272 of the Canadian Environmental Protection Act, 1999 apply, with any modifications that the circumstances require, in respect of this Act.

349. Section 19 of the Act is replaced by the following:

Application of provisions of the Canadian Environmental Protection Act, 1999

19. Sections 39 to 42, 275, 276, 280, 285, 288 to 290, 292 to 294 and 311 of the Canadian Environmental Protection Act, 1999 apply in respect of this Act

(a) as if each reference in any of those sections to section 291 of that Act were a reference to section 18 of this Act; and

(b) with any other modifications that the circumstances require.

350. The definitions "sell" and "standard" in section 2 of the Motor Vehicle Safety Act are replaced by the following:

"sell" includes to offer for sale or lease, have in possession for sale or lease or deliver for sale or lease;

"standard" means a standard that governs the design, construction, functioning or marking of vehicles or equipment for the purpose of reducing the risk of death, injury or property damage from vehicle use;

351. Paragraph 5(1)(c) of the Act is repealed.

352. Section 8 of the Act and the heading before it are repealed.

353. (1) Paragraph 9(1)(b) of the Act is replaced by the following:

(b) impede the development of new safety features that are equivalent to or superior to those that conform to prescribed standards; or

(2) Subsection 9(3) of the Act is replaced by the following:

Conditions for granting exemption

(3) An exemption may not be granted for a model if the exemption would substantially diminish the safe performance of the model or if the company applying for the exemption has not attempted in good faith to bring the model into conformity with all prescribed standards applicable to it.

354. Section 21 of the Act is repealed.

355. The Canadian Environmental Protection Act, chapter 16 of the 4th Supplement to the Revised Statutes of Canada, 1985, is repealed.

355.1(1) Subject to subsection (2), any regulation that was

(a) made under the Act mentioned in section 355, and

(b) in force immediately before the day on which this Act is assented to

is deemed to have been made under this Act, and continues in force, subject to being amended or repealed under this Act.

Where inconsistent with this Act

(2) If a regulation continued in force by subsection (1) is not consistent with this Act at the end of the two-year period that starts on the day on which this Act is assented to, that regulation ceases to be in force at the end of that period.

356. This Act or any of its provisions comes into force on a day or days to be fixed by order of the Governor in Council.
