Canadian Environmental Protection Act, 1999

Notice is hereby given that, pursuant to section 127 of the Canadian Environmental Protection Act, 1999 (CEPA), disposal at sea permit no. ATL‑00063‑1 authorizing the loading for disposal and the disposal of waste or other matter at sea is approved. The permit is published on the Canadian Environmental Protection Act Registry on Tuesday, September 10, 2019.

1. Permittee: Department of Public Works and Government Services, Moncton, New Brunswick.

2. Waste or other matter to be disposed of: dredged material.

2.1. Nature of waste or other matter: dredged material consisting of boulders, cobble, gravel, sand, silt and clay.

2.2. The permittee shall remove debris associated with but not limited to degraded sheet steel pilings and wooden structures from waste or other matter approved for loading and disposal at sea.

3. Duration of permit: permit is valid from November 1, 2019, to October 31, 2020.

3.1. The loading and disposal at sea activities are restricted to the following period(s): from November 1, 2019, to April 30, 2020, and from August 1, 2020, to October 31, 2020.

4. Reference documents:

  1. Figure 1 titled “Site Plan” (August 9, 2019), submitted in support of the application

  2. Figure 3 titled “Site Plan - DS1” (December 2018), submitted in support of the application

5. Loading site(s): Shippagan Gully, New Brunswick, at approximately 47.71900° N, 64.66580° W North American Datum of 1983 (NAD83), as described in paragraph 4a.

6. Disposal site(s):

  1. Shippagan Gully DS1, New Brunswick, from 47.72588° N, 64.64661° W to 47.73084° N, 64.63528° W (NAD83), as described in paragraph 4b

  2. Shippagan Gully DS2, New Brunswick, at approximately 47.72108° N, 64.66579° W (NAD83), as described in paragraph 4a

7. Method of loading: dredging will be carried out using heavy equipment operating from the east shore of Shippagan Gully or from temporary structures or floating structures protruding from or anchored to the east shore.

8. Route to disposal site(s) and method of transport:

  1. DS1: direct route from the loading site to the disposal site via truck or from the stockpile/laydown area to the disposal site via truck as per paragraph 4a

  2. DS2: direct route from the loading site to the disposal site via truck; from the stockpile/laydown area to the disposal site via truck or sidecasting

9. Method of disposal: via truck or sidecasting.

10. Total quantity to be disposed of:

  1. DS1: not to exceed 90 000 cubic metres, place measure

  2. DS2: not to exceed 60 000 cubic metres, place measure

10.1 The procedures to measure or estimate quantities of dredged material disposed of at the disposal site(s) shall be submitted with the Dredge Material Disposal Plan required by paragraph 14.1 prior to the commencement of the first dredging operation to be conducted under this permit.

11. Fees: the fee prescribed by the Disposal at Sea Permit Fee Regulations shall be paid by the permittee in accordance with those regulations as modified according to the provisions of the Service Fees Act. The applicable fee rates for April 1, 2019, are in effect for the duration of this permit.

12. Inspection and contractors:

12.1. By accepting this permit, the permittee and its contractors accept that they are subject to inspection by pursuant to Part 10 of CEPA.

12.2. At all times, a copy of this permit and of documents referenced in paragraph 4 shall be available at the loading site.

13. Reporting and notification:

13.1. The permittee shall provide the following information at least 48 hours before loading and disposal activities commence: name or number of ship, platform or structure used to carry out the loading and/or disposal, name of the contractor including corporate and on-site contact information, and expected period of loading and disposal activities. The above-noted information shall be submitted to:

13.2. The Canadian Coast Guard Marine Communication and Traffic Services of Sydney (navwarn.mctssydney@innav.gc.ca) is to be notified in advance of the commencement of work so that appropriate navigational warnings may be issued.

13.3 The permittee shall submit a written report to the minister, as represented by the Regional Director of the Environmental Protection Operations Directorate, Atlantic Region, care of Ms. Jayne Roma, as identified in paragraph 13.1a, within 30 days after the expiry of the permit. This report shall contain the following information: the quantity of matter disposed of at the disposal site(s) and the dates on which disposal activities occurred.

14. Special precautions:

14.1. The permittee shall prepare a dredged material disposal plan relating to the loading and disposal at sea activities authorized by this permit. The plan shall be submitted to the Department of the Environment prior to the commencement of the first dredging operation to be conducted under this permit. The plan shall include final loading methodology, boundaries of the stockpile/laydown area, procedures to accurately measure or estimate quantities of dredged material disposed of at the disposal sites, and a schedule for use of the disposal sites. The plan shall also address measures to segregate and dispose of debris encountered during dredging, spill prevention and response, scarp and erosion mitigation and mitigation measures related to Piping Plover, including but not limited to surveys and contingency measures should nests be encountered. Requests for modifications to the plan shall be made in writing to the Department of the Environment.
