Saskatchewan gas station owner and operator fined for environmental offences

Canadians value clean air and a sustainable environment. Environment and Climate Change Canada’s enforcement officers work tirelessly to protect our environment through the enforcement of our federal environmental laws.

On January 16, 2017, Napoleon Albert Medal and Jeannette F. Medal, owner and operator, respectively, of a gas station located within the Black Lake reserve, were found guilty in the Provincial Court of Saskatchewan for failing to comply with a court order issued by a provincial judge, on October 3, 2013, under the Canadian Environmental Protection Act, 1999. On January 19, 2017, Napoleon and Jeannette Medal were each fined $10,000, for a total of $20,000, which will be directed to the Environmental Damages Fund.

The court order had directed Napoleon and Jeannette Medal to meet several requirements to ensure compliance with the Storage Tank Systems for Petroleum Products and Allied Petroleum Products Regulations pursuant to the Act.

On April 7, 2015, the court was advised that the Medals had failed to meet all of the requirements identified in the order, and charges were subsequently laid by Environment and Climate Change Canada. In addition to the fines, the court issued a subsequent order to Napoleon and Jeannette Medal, which instructed them to complete an emergency plan, to conduct and correct any issues found during environmental audits, and to report back to the Department’s enforcement officers.
