Substance Groupings Initiative

The following substances in this Batch have been included in the Aromatic Azo and Benzidine-based Substance Grouping under Substance Groupings Initiative as part of the second phase of the Chemicals Management Plan. As outlined in the notice of intent for the Aromatic Azo and Benzidine-based Substance Grouping, it was recognized that assessments and conclusions pertaining to some of the substances in the grouping may be subsequently updated as part of the subgroup assessment. The latest updates on these substances are found on the respective Substance Groupings Initiative pages.

Varying the requirements under the Significant New Activity provisions

In February 2022, a notice of intent to amend the DSL to vary the requirements under the SNAc provisions for 3-chloropropene (CAS RN 107-05-1) and DMEP (CAS RN 117-82-8) was published in the Canada Gazette, Part I: Vol. 156, No. 6 – February 5, 2022  for a 60-day public comment period. The proposed amendments are an outcome of the SNAc Review. The DSL amendments do not come into force until the final order is published in the Canada Gazette, Part II. Any current requirements under the SNAc provisions remain in effect until then.

In January 2017, a notice of intent to amend the DSL to vary the requirements under the SNAc provisions for benzyl chloride (CAS RN 100-44-7) was published in the Canada Gazette, Part I: Vol. 151, No. 2 - January 14, 2017. The proposed amendment is an outcome of the SNAc Review. The DSL amendment do not come into force until the final order is published in the Canada Gazette, Part II. Any current requirements under the SNAc provisions remain in effect until then.

Rescinding Significant New Activity provisions

In October 2016, the SNAc provisions on Solvent Red 3 (CAS RN 6535-42-8) were rescinded. Solvent Red 3 was subject to the SNAc provisions as a result of the 2010 assessment of Batch 6 of the Challenge. Solvent Red 3 has since been included in the Certain Azo Solvent Dyes Subgroup, and the 2016 assessment of that subgroup concluded that Solvent Red 3 does not pose a risk to the environment or human health. An order was published in the Canada Gazette, Part II: Vol. 150, No. 21 - October 19, 2016 rescinding the obligations under the SNAc provisions of CEPA 1999 concerning this substance.

Final screening assessments and risk management approaches

In September 2011, the final screening assessments for the remaining 4 substances in this batch were released and the related notices were published in the Canada Gazette, Part I: Vol. 145, No. 37 - September 10, 2011.

In November 2009, the final screening assessments for 14 of the 18 substances in this batch were released and the related notices were published in the Canada Gazette, Part I: Vol. 143, No. 48 - November 29, 2009.

The final screening assessments concluded that 2 substances in this batch meet one or more criteria in section 64 of the CEPA 1999. The Government added these substances to Schedule 1 of the Act. Proposed risk management approaches were also released for the substances in this batch which met the criteria in section 64 of CEPA 1999.

Draft screening assessments and risk management scopes

New information was received from industry or interested stakeholders for each of the 18 substances in this batch. In May 2009, the draft screening assessments were released and the related notices were published in the Canada Gazette, Part I: Vol. 143, No. 22 - May 30, 2009. Risk management scopes were also released in conjunction with these publications.

In October 2010, a notice relating to the release of the draft screening assessments for the 4 remaining substances in Batch 6 (CAS RNs 85-86-9, 6358-57-2, 7147-42-4 and 19800-42-1), was published in the Canada Gazette, Part I: Vol. 144, No. 40 - October 2, 2010.

New content has been added regarding the human health aspects of the assessments and has led to the re-publication of the draft screening assessments on these substances in order to allow a public comment period on the updated content. Risk management scope documents were also released in conjunction with these publications.

Information gathering

2008 Mandatory survey - section 71 notice

In May 2008, a notice was issued in the Canada Gazette, Part I: Vol. 142, No. 22 - May 31, 2008 under section 71 of CEPA 1999. This notice applied to all 18 substances in this batch.
