Dear Mr. Langlois:

Under Chapter 23 of the James Bay and Northern Quebec Agreement (JBNQA), I appointed the Federal Environmental and Social Impact Review Panel (COFEX-North) with the mandate to examine the Canadian Royalties Inc.'s port infrastructure construction project in Deception Bay in Nunavik. This project replaces a similar project that was approved in 2008 and that the proponent proposes to relocate.

To carry out its mandate, the Panel will have to use the relevant data from the completed 2008 review that the executive secretary will pass on to you. More precisely, the mandate includes consideration of the impact statement of the new project, the formulation of additional information requests as required, as well as the conduct of public consultations, if deemed necessary by COFEX-North. COFEX-North will also have to prepare, for my consideration, a detailed recommendation report which will include, but not be limited to, the following:

  • The proponent's submission;
  • A description of the project, its location and related components;
  • The main steps of COFEX-Nord`s review process, including public consultations, as appropriate;
  • A brief description of the biophysical and human environment, as well as of the main issues considered;
  • Comments and concerns raised by the communities and how they were integrated in the analysis;
  • COFEX-Nord conclusions and recommendations on the impact assessment of the project and proposed mitigation actions;
  • COFEX-Nord recommendations related to environmental monitoring and follow-up;
  • COFEX-Nord final recommendation for the approval of the project and related conditions.

I rely on COFEX-North to develop and maintain a close collaboration with the federal authorities to coordinate, to the extent possible, this review, under section 23 of the JBNQA, with the one conducted under the Canadian Environmental Assessment Act. This cooperation will include the exchange of information and expertise, as well as the coordination of community consultation activities.

For the sake of transparency, I encourage COFEX-North to use the project Internet Registry at www.acee.gc.ca (tab JBNQA) in order to make public the information relating to the review.
