Revised chapters of the Manual of Patent Office Practice released
News release
The Canadian Intellectual Property Office (CIPO) has revised several sections in chapters 1–3, 13, 17 and 23 of the Manual of Patent Office Practice (MOPOP).
The revisions provide clarified guidance on the following:
- chapters 1–3 have been updated to reflect the most recent practice notice respecting correspondence procedures and to provide clarification on operational formalities procedures
- chapters 1 and 13 have been updated to include information relating to the Patent Examination Interview Service
- chapter 17 provides clarified practice guidance with regard to the presentation of sequence listings, which is particularly pertinent with regard to amendments that intend to remove non-essential sequence(s) from a listing
- chapter 23 has been updated with practice guidance for the examination of multiple co-pending applications for reissue for the same patent
A comprehensive list of the changes is available online on the MOPOP Revision History web page.
The MOPOP is a guide for patent examiners, applicants, agents and members of the public who are looking for information about the operational procedures and examination practices of CIPO.
Practices expressed in the MOPOP reflect the Patent Office's interpretation of the Patent Act, the Patent Rules and jurisprudence, as of the date each chapter or section came into effect. The revised chapters reflect the Patent Office's official practice.
