Release - Compulsory, Release - Conduct/Performance

Case summary

F&R Date: 2015-09-18

After multiple issues of misconduct, over a period of a few years, which resulted in the grievor losing his Military Police credentials, being placed on initial counselling, recorded warning, and counselling and probation, the grievor was subjected to an administrative review (AR) and ultimately released under item 5(f). He challenged the AR decision stating that he had overcome his shortcomings. The grievor argued in part that his lapses were due to his sex addiction, that although he had a relationship with a cadet in a unit he was volunteering with, she was 18 years old and that allegations by several women were untrue.

The Committee found that the incidents of misconduct were serious and numerous and that the 5(f) release was justified. The Committee therefore recommended that the grievance be denied

FA decision summary
