Case Summary

The grievor disputed the assessed failure of his operational training assessment, claiming that he was prejudiced by the evaluator during the assessment, that a Training Review Board was not convened and that he was not provided an agreed-upon re-assessment opportunity. As redress, he requested a pass for the assessment or a recourse with the full costs borne by the training unit.

The Initial Authority (IA) granted partial redress in the form of a fully funded recourse with different evaluators, but directed that the grievor must repeat the entire assessment.

The Committee found that the grievor was denied procedural fairness because contrary to the Qualifying Standard and Plan for the course, a Training Review Board was required, but not convened, to address the grievor's failure. The Committee also found that the grievor was not afforded a re-test, contrary to what he was initially told would occur.

The Committee recommended that the grievor be granted a fully funded recourse with different evaluators as indicated by the IA. The Committee also recommended that the extent of the recourse required be determined by subject matter experts within the applicable Training Command. Finally, the Committee recommended that the Commander of the training unit be directed to comply with the Training Review Board requirements of the Qualifying Standard and Plan.

FA Decision Summary

There is no Final Authority decision as the grievor withdrew the grievance.
