The grievor ranked 10th on the promotion board merit list for her sub-occupation and expected to be promoted and posted to an identified vacant position. However, she was bypassed in favour of another individual who ranked lower on the promotion board merit list and was subsequently promoted in accordance with the bypass policy. The grievor suspected that her temporary employment limitations played a role in the decision to bypass her for promotion. As redress, she requested retroactive promotion with associated pay and posting allowance.

The Initial Authority denied the grievance on the grounds that Canadian Armed Forces policy authorizes out of sequence promotions and the vacant position required specified training that the other individual could attain quicker than the grievor could.

The Committee found that there was no evidence to suggest that the grievor's medical condition was a factor in the decision to promote the lower-ranked individual ahead of her. Rather, the evidence showed that the gaining unit simply concluded that the other individual could acquire the position requirements faster than the grievor, which in fact turned out to be true. On that basis, the Committee found the decision to promote the other individual first was reasonable and compliant with applicable policy.

Consequently, the Committee recommended that the Final Authority (FA) not afford the grievor redress.
