The grievor received an enrollment offer for the Regular Force (Reg F) that was less than the grievor's pay in the Cadet Organizations Administration and Training Service (COATS), and at a lower substantive rank. The grievor argued that the Canadian Forces Military Personnel Instruction (CF Mil Pers Instr) 03/08 was unfair to members of COATS, as members of the Primary Reserve (P Res) can component transfer (CT) to the Reg F with rank protection. As redress, the grievor requested an enrollment offer in the Reg F with a higher salary and a higher rank.

The Commander Canadian Forces Recruiting Group, acting as the Initial Authority, could not determine the grievance within the time limit.

Following the grievance submission, the grievor undertook a CT from COATS to the P Res and no longer wished to CT to the Reg F.

The Committee found that it was both reasonable and necessary for the CF Mil Pers Instr 03/08 to treat COATS members differently with regards to rank protection and there was no need to expand the rank protection provisions nor review the policy for members of COATS.

The Committee also found that the grievor's qualifications and experience were exceptional and warranted special consideration should the grievor choose to pursue a CT from the P Res to the Reg F in the future.

The Committee recommended to the Final Authority not to afford redress to the grievor.
